To access our Service, you must create an account by providing:

You are responsible for:

5. Pricing and Payment

Our pricing is clearly displayed on our website. All prices are in USD unless otherwise stated. We offer:

5.2 Payment Terms

Payment is due at the time of service purchase. We accept credit cards, debit cards, and other payment methods through our payment processor. By providing payment information, you authorize us to charge your payment method for all fees incurred.

5.3 Refund Policy

Due to the nature of our AI-generated services, all sales are final once work has commenced. We offer refunds only in the following circumstances:

  • Technical failure preventing service delivery
  • Duplicate payment or billing error
  • Request made within 24 hours before any work has begun

Refunds will be processed within 7-10 business days to the original payment method.

You retain ownership of all personal information, documents, and content you upload to our Service. By using our Service, you grant us a limited, non-exclusive, royalty-free license to:

  • Improve our AI models (using anonymized, aggregated data only)

6.3 AI-Generated Content

The petition drafts we generate for you are yours to use. However:

  • You must review and verify all AI-generated content
  • We are not liable for inaccuracies in AI-generated text
  • You may not claim the petition templates or structure as your own intellectual property

7. Disclaimers and Limitations of Liability

7.3 Service Provided "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKPETITION SHALL NOT BE LIABLE FOR:

  • USCIS petition denials or rejections
  • Immigration status consequences
  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • AI errors, inaccuracies, or omissions
  • Third-party AI provider service failures

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless QuickPetition, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the Service
  • Violation of these Terms
  • Violation of any laws or regulations
  • Infringement of intellectual property rights
  • False or fraudulent information provided to USCIS
  • Any immigration consequences resulting from petition submission

9. Third-Party Services

Our Service uses third-party AI providers and cloud services for:

  • AI Processing: Third-party language models for petition generation
  • Cloud Infrastructure: Secure hosting and data storage services
  • Email Delivery: Transactional email service providers
  • Payment Processing: Stripe for secure payment processing

These third-party services have their own terms and privacy policies. We are not responsible for their practices or service interruptions.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

10.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.

Class Action Waiver: You agree to resolve disputes with us on an individual basis only, and not as part of any class action, consolidated action, or representative action.

11. Changes to Terms

Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Termination

Either party may terminate this agreement:

  • You: Delete your account at any time through your profile settings or privacy page
  • Us: Suspend or terminate your account for Terms violations, fraud, or harmful conduct

Upon termination:

  • Your access to the Service will cease immediately
  • You may download your data before account deletion
  • We will retain data as required by law or our Privacy Policy
  • Sections 6, 7, 8, 10, and 13 survive termination

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuickPetition.

13.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not transfer or assign your rights under these Terms without our written consent. We may assign our rights without restriction.

13.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, internet service disruptions, or third-party AI service outages.
